the elephant in the room

the reddheadd at firedoglake has a great post on the legal doctrine on the fruit of the poisonous tree and the threat it may pose to convictions obtained via the warrantless searches that awol's boys have been conducting.

here's our question - why does anyone think awol's going to bother with trials? if he decides these folks are enemy combatants, he'll throw 'em in the clink for the duration of gwot (which will last until his environmental policies initiate the next ice age). for the rest of us, citizens, journalists, politicians, who might have foolishly engaged in scrutiny of or opposition to his awol-ness' policies - they don't want trials, they just want to know what we're up to.

the thing about legal doctrines is they only work in societies in which everyone is subject to a system of laws and ordered liberties. why should we believe we live in one anymore?
